Ultimamente recibo muchas preguntas del estilo:
“…hola, soy un [artista/director/creador] y me gustaría usar tu música para una [obra/película] que estoy haciendo. Me gustaría saber si la licencia en que tienes tu música me lo permite.”
La respuesta rápida es: NO. Si lees la licencia, uno de los apartados especifica que NO se pueden crear obras derivadas. La respuesta larga es: DEPENDE. Depende de la obra que estés creando y del uso que vayas a darle.
¿Por qué me decidí a poner en la licencia de mi música el apartado de “No crear obras derivadas? Podría haber elegido la de “puedes crear obras derivadas, pero siempre que compartas con las mismas licencias”, sin embargo, soy una persona con mis convicciones morales, sociales, políticas y religiosas, y no me gustaría encontrar que mi música se ha usado en la campaña de Bush o para promocionar el foro de la familia, por ejemplo.
Esto quiere decir que no tengo ningún problema en que se use mi música en una obra que aspira a los ideales de las licencias copyleft, es decir, cuya intención no es enriquecerse a base de arte privativo, sino compartir el arte y hacerlo disponible a la gente. Esto es una cuestión más filosófica que económica, de modo que si quieres usar mi música en tu obra, debes ponerte en contacto conmigo en bosquesdemimente(at)gmail(dot)com y hablarme sobre tu obra, sobre su filosofía, en qué se basa, para qué se va a usar, si se va a distribuir y cómo, etcétera, y si las condiciones me parecen adecuadas no tendré ningún problema en que uses mi música.

I am receiving lots of questions lately regarding the usage of my music:
“… hello, I am a [director/artist/film student] who would like to use your music in my [work/film], and I wonder if your license allows me to do that…”
The sort answer is: NO. If you read the license, one of the sections clearly specifies that you cannot create derivative works. The long answer is: IT DEPENDS. It depends on the work you are creating and the usage you have for it.
While I could have chosen a “share-alike” license that would allow everyone to create derivative works while licensing under the same conditions, I decided to put my music under the “no derivative works” tag, why? well, I am a person with my own social, moral, religious and political convictions, and would not like to find my music has been used in the George W. Bush campaign, in some kind of religious act or in a mega-hit techno song (just to name some examples).
That implies I have no problem in my music being used in some piece of art that aspires to the ideals of copyleft, i.e: whose intention is not to gain money by privative art, but to share art and put it available for everyone. This is a deep philosophical question for me, not just a economical one. Thus, if you want to use my music and agree with what I have said, you should put in contact with me at bosquesdemimente(at)gmail(dot)com and talk me about your work, what do you intend with it, which are your plans for its distribution, and what’s behind all that. If we share the same view on the issues I have discussed above I have no problem in you using my music for your work.
